General Conditions of Sale

Welcome to our online sales site! Your orders are governed by the following rules:

  1. Your contract with us

These General Conditions of Sale (GCS) apply to any services, orders and dispatches of goods that you as the client order online on the website of www.www.epigeneva.com. In placing an order, you acknowledge that you have read, understood and accepted these GCS without reservation.

EPIGENEVA reserves the right to amend these GCS at any time by publishing a new version on the website. The placing of any order after the publication of the new version of the GCS shall be construed as acceptance thereof.

In using the website www.www.epigeneva.com, you further accept that you will be subject to our Website Terms of Use and to our Privacy Notice. Please read these carefully.

  1. Registration

If you sign up before placing an order, please ensure that the data provided is precise and complete before submitting the order; you undertake to update your personal data in the event of any change of address or any other modification.

You also undertake to ensure that the password chosen when signing up remains confidential and is not disclosed to third parties.

You can object at any time to receiving marketing messages by sending an email to info@epigeneva.ch or by writing to EPIGENEVA AG, Seestrasse 155 B, 8802 Kilchberg, Switzerland.

  1. Orders and availability

A contract shall only be concluded between you as the client and EPIGENEVA upon the submission of your order and its acceptance by us.

Your order may be placed on our website using the order form provided by EPIGENEVA. It shall be subject to the prices and information posted on the website on the day of the order.

We shall inform you by email in the event that any product should become unavailable after your order has been placed.

Please note that your payment card will only be charged at the time of shipment. Your card will not be charged if you decide to cancel your order.

EPIGENEVA reserves the right to refuse any order if:

  • the value exceeds CHF 1,000.00;
  • payment is declined by the bank;
  • the order is deemed to be fraudulent.

 

  1. Subscription

 

The subscription involves the dispatch every calendar month of one or more products selected by the client.

 

The subscription implies the dispatch or respectively receipt each month of the product or products selected until you decide to end the contract. In accepting this subscription, you consent to an automatic monthly payment in an amount defined at the time of the initial order.

 

You can cancel your monthly subscription at any time in the area “My account”. If you cancel after the automatic payment has been processed, an order shall be deemed to have been concluded for the month concerned, and you can no longer request the cancellation of this order. The cancellation of the subscription shall take effect from the following month.

 

  1. Delivery and time limits

EPIGENEVA delivers in Switzerland only and all orders placed on www.www.epigeneva.com are restricted to the territory of Switzerland. Your order shall be delivered to the delivery address indicated by you. Liability for the goods shall pass to the client at the time they are received by the shipping agent. In order to guarantee proper delivery as quickly as possible, we have established a partnership with the company “Société des Entrepôts Vevey SA”.

The delivery deadlines shall be those indicated in the order confirmation for both cosmetic products and for gift certificates.

  1. Checking and return of goods

You must check the quantity and proper condition of the goods upon delivery. In the event of any breakage, delivery error or defective goods, you must submit a written claim to EPIGENEVA within 5 working days of the delivery through our Customer Service (info@staging.epigeneva.com and telephone numbers mentioned on the website).

The costs of return shipment within Switzerland shall be reimbursed to you and credited to your personal account or by bank transfer. Items must be returned in their original packaging.

We shall take the necessary steps to replace defective products or to reimburse you in the form of a credit note.

We make every effort to offer our clients products of the highest quality. However, if you are not satisfied with the goods ordered, you may inform our Customer Service in writing to withdraw from the contract within 14 days.

  1. Price

The prices indicated on the website along with the delivery charges are stated in Swiss francs and include VAT. EPIGENEVA reserves the right to alter its prices and delivery charges at any time. Any prices indicated in euros are purely estimates and shall not be binding for EPIGENEVA.

The delivery charges are specified on the order page.

  1. Payment terms

Payment shall be made prior to delivery of the goods, or by credit card (Visa, Mastercard, Postfinance).

  1. Data protection

Your personal data shall be collected exclusively in accordance with legal requirements and shall be processed in line with our Privacy Notice. You authorise Société des Entrepôts Vevey SA (or the shipping agent selected) to disclose your exact address in the event that it has not been possible to deliver the shipment to the address specified.

  1. Validity of the General Conditions of Sale

 

Should any of these GCS be declared void or partially invalid, this shall not affect the validity and scope of the remaining clauses. The invalid terms shall be replaced by legally applicable provisions of Swiss law, including any matter not regulated under these GCS.

 

  1. Disclaimer

Without prejudice to the scope of these GCS, no claim whatsoever relating to products delivered or the failure to deliver products or any other claim may exceed the purchase price of the goods that gave rise to a damage claim. EPIGENEVA may not under any circumstances be held liable for any indirect, incidental or consequential losses of any type whatsoever arising in relation to its products, their usage, their sale or this website.

The client is obliged to familiarise himself/herself with and to abide strictly by the indications contained in the user instructions before applying the product. Products must be protected against excessive humidity, excessively high temperatures or excessively intense glare and may only be usable within a certain number of days after opening as mentioned on the product or on the user instructions. The guarantee shall therefore not apply to any products that have not been stored in the manner specified above.

  1. Applicable law

These General Conditions of Sale shall be governed by Swiss law.
